Acceptance of Terms

By accessing or using the Niero app, you agree to be bound by these Terms and to comply with all applicable laws and regulations. If you do not agree to these Terms, you are not permitted to use the Niero app.

Who Can Use the Service

The Niero application is intended for individuals who are at least 14 years of age. If you are under the age of 18, you must use the Niero application only with the explicit consent and supervision of a legal guardian. By using the Niero application, you represent and warrant that you meet these age requirements.

User Account

To use the Niero application, you must create an account and provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify Niero immediately of any breach of security or unauthorized use of your account via email at support@niero.app.

Use of the Service

The Niero application is for your personal, non-commercial use only. You may not use the service for any illegal or unauthorized purpose. Niero reserves the right to terminate your use of the service for any violation of these terms.

User Content

The Niero application allows users to upload, share, and post content, including but not limited to text, photos, and videos (collectively, 'User Content'). You retain all rights in, and are solely responsible for, the User Content you make available through the Niero application. By making any User Content available through the Niero application, you grant to Niero a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised, without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.

User-Generated Audio Content & Copyright Policy

• Niero allows users to upload short audio clips and sounds ('User Audio') for use on their profiles and posts. By uploading User Audio, you expressly represent and warrant that you are the original creator of the audio or that you hold all rights, licenses, and express permissions required for its use and distribution. You assume full and exclusive legal liability — including one hundred percent (100%) of any commercial distribution liability — arising from the upload, use, or distribution of that audio, and Niero bears no liability for User Audio you make available.
• Niero operates an end-to-end reporting and takedown mechanism for audio content. Any user or rights holder may report an audio clip they believe infringes copyright. Niero reserves the right to remove, mute, or disable any flagged or infringing audio object immediately and without prior notice.
• Soft Takedown framework: where an audio clip is removed for a copyright violation, every post using that specific audio ID is permanently muted (its audio is disabled), while the posts themselves and their engagement — likes, comments, and views — remain intact.
• Repeat Offender Policy: accounts that accumulate multiple copyright strikes may have audio upload and related features restricted, and repeated or serious infringement will result in permanent termination of the account.
• To report copyright infringement, contact our designated copyright channel at support@niero.app with the subject 'Copyright Report', including a link to or identifier of the infringing audio and evidence of your rights.

Copyright Notices and Counter-Notices

• Niero responds to clear notices of alleged copyright infringement. Notices should be sent to our copyright agent at support@niero.app with the subject line 'Copyright Notice'.
• To be effective, a notice of claimed infringement must include: (1) a physical or electronic signature of a person authorised to act on behalf of the copyright owner; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material claimed to be infringing, with enough detail for us to locate it — for audio, the sound's title, its link, or the post using it; (4) the notifier's contact details, including address, telephone number and email address where available; (5) a statement that the notifier has a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law; and (6) a statement that the information in the notice is accurate, that the notifier is authorised to act on the copyright owner's behalf, and that the notifier accepts legal responsibility for the accuracy of the notice.
• On receipt of a compliant notice we will promptly remove or disable the material identified, and will make reasonable efforts to notify the user who uploaded it, who may then submit a counter-notice. Where the material is an audio clip, removal takes effect as described in our User-Generated Audio Content policy: the sound is disabled and every post using it is muted, while those posts and their engagement remain.
• If you believe your material was removed by mistake or misidentification, you may send a counter-notice to support@niero.app containing: (1) your physical or electronic signature; (2) identification of the removed material and where it appeared before removal; (3) a statement that you have a good-faith belief the material was removed as a result of mistake or misidentification, and that you accept legal responsibility for the accuracy of that statement; and (4) your name, address and telephone number, together with a statement that you consent to the jurisdiction of the courts of Kuwait City in accordance with the governing-law provision of these Terms, and that you will accept service of process from the party who submitted the original notice.
• On receipt of a valid counter-notice we will forward a copy to the original complainant and may restore the removed material after ten (10) business days, unless the complainant notifies us within that period that they have commenced legal proceedings seeking to restrain the allegedly infringing activity.
• A person who knowingly makes a material misrepresentation — either that material is infringing, or that it was removed by mistake — may be liable for the resulting damages under applicable law. Accounts found to have repeatedly infringed the rights of others will be disabled in accordance with our repeat-infringer policy.

User Conduct

You agree not to engage in any prohibited activities, including but not limited to copying, distributing, or disclosing any part of the Niero application, transmitting spam, or attempting to interfere with the security or functionality of the application. Any content deemed sexual or pornographic in nature will result in permanent action against the perpetrator.

Proprietary Rights

The Niero application contains material owned by Niero or third parties, protected under Kuwait and foreign laws. Unauthorized use may violate copyright, trademark, and other laws.

Disclaimers

• Niero provides the Niero application on an 'as is' and 'as available' basis.
• Niero does not warrant that the application will be uninterrupted or error-free.
• Niero does not guarantee that the application will be free from loss, corruption, viruses, or hacking.

Limitation of Liability

To the fullest extent permitted by law, Niero is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the application.

Indemnification

You agree to indemnify and hold harmless Niero and its affiliates from any claims arising out of your violation of these Terms.

Changes to the Terms

Niero reserves the right to modify or replace these Terms at any time. Material changes will be notified at least 30 days in advance via the app or the Niero website.

Termination

Niero may terminate or suspend your use of the application at any time, with or without notice, for violations of these Terms.

Content Moderation and Appeals

• Niero employs both automated systems and human reviewers to moderate content and ensure compliance with our community guidelines.
• If your content is removed or your account is restricted, you have the right to appeal our decision by contacting support@niero.app.
• All appeals will be reviewed by our human moderation team within 72 hours of receipt.
• We are committed to transparent content moderation practices and will provide clear reasons for any enforcement actions.

AI-Generated Content

• Users are responsible for clearly labeling any AI-generated content they share on the platform.
• Misrepresenting AI-generated content as human-created is prohibited and may result in account restrictions.
• We reserve the right to implement technical measures to detect and label AI-generated content.
• AI-generated content must comply with all other terms of service and community guidelines.

Accessibility

• Niero is committed to making our platform accessible to users with disabilities.
• We strive to comply with Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards.
• If you encounter accessibility barriers, please contact us at support@niero.app so we can address them promptly.
• We regularly audit our platform for accessibility improvements and welcome user feedback.

General Terms

• These Terms constitute the entire agreement between you and Niero regarding the application.
• These Terms are governed by Kuwaiti law, and disputes shall be resolved in Kuwait City courts.
