1. Copyright notice
- Send a signed written notice identifying the copyrighted work, the material claimed to infringe, and enough information for Niero to locate it, such as a URL, post ID, account, or audio ID.
- Include your name and contact information, a good-faith statement that the disputed use is not authorized by the owner, agent, or law, and a statement under penalty of perjury that the notice is accurate and you are authorized to act for the owner.
- Send notices to business@niero.app with “DMCA Notice” in the subject. Niero may request missing information before acting.
2. What happens after a notice
Niero may remove or disable access to identified material, preserve records, and notify the uploader. For shared audio, disabling an audio object may mute each post that references it. Niero may forward the notice, including contact information, to the uploader or as otherwise required by law.
3. Counter-notice
- A counter-notice must identify the removed material and its former location, include your physical or electronic signature, and state under penalty of perjury that you have a good-faith belief the material was removed because of mistake or misidentification.
- Include your name, address, and telephone number, and state that you consent to the jurisdiction of the federal district court for your address, or, if outside the United States, any federal district where Niero, LLC may be found, and that you will accept service from the original notifier or their agent.
- If the counter-notice is valid, Niero will send it to the notifier and may restore the material no fewer than 10 and no more than 14 business days later unless the notifier informs us that a qualifying court action has been filed.
4. Repeat infringers
Niero maintains a policy of terminating repeat infringers in appropriate circumstances and may restrict uploads or terminate an account for serious infringement. Strikes may be reversed where a notice is withdrawn, a counter-notice succeeds, or Niero determines that enforcement was mistaken.
5. Misrepresentation and other rights
Knowingly making material misrepresentations in a notice or counter-notice may create liability. The DMCA process is for copyright, not trademark, privacy, defamation, or general disputes. Contact support@niero.app for other legal reports.
